Disclaimer

§ 1. General

(1)     The web site of the workshop on Identification, Protection and Management of Landscapes based on Natura 2000 (hereafter: the landscape workshop web site) is maintained by the National Nature Protection Service (hereafter: the NNPS) with the aim of enhancing public access to the outcomes of the said workshop. In addition, the web site provides information about the European Landscape Convention and landscape protection policies in general at the international and national level.

(2)     The information on the landscape workshop web site consists of own contents of the NNPS and of external contents, access to which is provided via hyperlinks.

(3)     The use of the landscape workshop web site takes place on the basis of these terms and conditions of use. The user accepts these as soon as he/she has been informed of them, has had a reasonable opportunity to read them and continues to use the web site.

(4)     This disclaimer is not intended to limit the liability of the NNPS in contravention of any requirements laid down in applicable national law nor to exclude its liability for matters which may not be excluded under that law.

 

§ 2. Responsibility for contents

(1)     For its own content, which the NNPS has ready for use, the NNPS is responsible only in accordance with the general law.

(2)     For the contents of external web sites, to which merely access via hyperlinks is provided, the NNPS is not responsible. In particular, the NNPS does not adopt the contents of these web sites as its own, for the NNPS has no influence on the contents and design of the linked sites. The use of links which start from the landscape workshop web site is therefore the user's own responsibility.

(3)     The NNPS is not responsible for the correctness, completeness, reliability or freedom from viruses of the contents of web sites of third parties, to which access via hyperlinks is provided. It is for the user to check the correctness of the information used. The use of contents provided by third parties takes place at the user's own risk and this process is subject to the prevailing national laws in each case and to international laws, in particular with regard to copyright law.

(4)     The information contained in the landscape workshop web site is not official information released by the NNPS, the Ministry of Environment and Water or any of its structures, and it should not be construed as such. The opinions reflected in the reports and the presentations represent solely the viewpoints on the subject of the respective author(s), and in no way are binding to the NNPS, the Ministry of Environment and Water or its structures.

(5)     This information is:

-      of a general nature only and is not intended to address the specific circumstances of any particular individual or entity;

-      not necessarily comprehensive, complete, accurate or up to date;

-      sometimes linked to external web sites over which the NNPS has no control and for which the NNPS assumes no responsibility;

-      not professional or legal advice (if you need specific advice, you should always consult a suitably qualified professional).

(6)     The NNPS, the Ministry of Environment and Water or its structures shall in no event be held responsible for injuries or losses of any kind (including but not limited to actual losses or lost profits) incurred by or in any way connected to the use of the information contained in the landscape workshop web site.

(7)     Otherwise the responsibility will be in accordance with the general law.

 

§ 3. Technical availability

For technical reasons the system can from time to time be used only temporarily and/or for only part of the contents. The NNPS will make an effort to make available the best service technically possible. A right to unrestricted access to what is offered does not exist.

 

§ 4. Exclusion of liability for software

The software used by the NNPS has been checked before being used. However, some data or information on the landscape workshop web site may have been created or structured in files or formats that are not error-free, and the NNPS cannot guarantee that the service will not be interrupted or otherwise affected by such problems. The NNPS accepts no responsibility with regard to such problems incurred as a result of using this site, in particular for errors. The same applies for material and programs, which are offered on any linked external web sites independent of the NNPS.

 

§ 5. Exclusion of liability for the web site

The landscape workshop web site is offered in compliance with the world-wide accepted principle of offering of goods and services AS IS. The NNPS accepts no responsibility with regard to any possible incompatibility between the web site or its individual elements and the user's specific hardware and software. The NNPS accepts no responsibility with regard to any possible damages of any kind in the user's hardware or software incurred by or in any way connected to the use of the landscape workshop web site.

§ 1. Copyright law

(1)     The layout of the landscape workshop web site, as well as the composition of the contents, is protected by the relevant national and international copyright law. This also applies to the external materials, the access to which is provided via hyperlinks. The individual presentations and reports are themselves likewise protected by the national and international copyright law.

(2)     The landscape workshop web site is designed for information and education only and is free to use for non-commercial purposes. A single copy of each presentation or report may be downloaded for personal, non-commercial, educational or research use and reference. When used for reference, the source must be duly acknowledged. Alterations are forbidden!

(3)     Where prior permission must be obtained for the reproduction or use of textual and multimedia information (sound, images, software, etc.), such permission shall cancel the above-mentioned general permission and shall clearly indicate any restrictions on use.

(4)     For any use for commercial purposes, or to make or distribute additional copies, the prior written permission by the NNPS must be obtained.
